PMCs in Russia today: legalization or shadow existence

Abstract. This article examines the current situation with the private military company Wagner in 2023, including in light of the death of its owner and co-founder, Yevgeny Prigozhin. It is noted that the lack of certainty in the legal status of the formation in question does not allow regulating its activities and taking any measures in case of complications, as happened in June 2023 during the military rebellion of Yevgeny Prigozhin. It is separately emphasized that the current freeze of the actions of the Government of the Russian Federation regarding the legalization of private military companies in Russia is due to the lack of a final consensus as a result of ongoing discussions on the need for PMCs as a formation on the territory of this state in principle. It is also an important fact that attempts to legalize PMCs, begin to regulate their activities and give them any specific status have so far failed: none of the proposals over the past 11 years have been accepted. The results of a public survey of respondents on the issue of further actions regarding private military companies in the Russian Federation by the state are also presented. As a result, it is emphasized that there is a recognized need to determine the possibility or impossibility of creating and operating private military companies in the territory of the Russian Federation through the implementation of a specific Federal law on this topic. However, at the moment there is not only any final decision, but also movement on the proposed bills, in connection with which there is no visible solution to the current situation.
