Positive and negative aspects of legislative initiatives of business entities in the Russian Federation

Abstract. Within the framework of the article, the peculiarities of the manifestation of legislative initiatives of business entities in the Russian Federation are considered, examples of legislative participation of business in the proposal of ideas and amendments for the development of regulatory legal acts of various levels are given. The positive and negative sides of the norm-oriented interaction of business entities with the authorities are highlighted. Objective: to analyze real examples of the participation of business entities in the rule-making process, in the proposal of ideas for amendments to regulatory legal acts of various levels, according to the results of which to highlight the advantages and disadvantages of such participation. Objectives: to study the theoretical aspects of the concept of the term «legislative initiative»; to give and consider examples of legislative initiatives of business entities in the Russian Federation; to highlight the advantages and disadvantages of business participation in the development of new and amendments to existing regulatory legal acts. Methods: description, generalization, synthesis, abstraction, idealization, deduction, induction, systematization, research, comparison, analysis. Results: the definition of the term «legislative initiative» is formulated; based on the analysis of examples of legislative initiatives of business entities, the advantages and disadvantages of the participation of Russian entrepreneurs in the adoption and amendment of regulatory legal acts of the Russian Federation are revealed. Conclusions: the following can be attributed to the positive aspects of legislative initiatives of business entities in the Russian Federation: the ability to reduce risks, the negative impact of sanctions, the economic crisis and other external factors on business; supporting the development of industries in difficult political and economic periods; popularization of entrepreneurship and an increase in the number of small businesses; and other advantages. Among the negative aspects of legislative initiatives of business entities are the following: reduction of the revenue part of the federal, regional or local budget due to the predominance of business interests over the interests of the state; lack of an objective approach to the rule-making process due to the fact that entrepreneurs can present a rule-making initiative in the interests of only one party — business; the predominance of the commercial component over the social interests of society.
