Abstract.<\/strong> Punishment in the form of imprisonment traditionally refers to one of the most serious in terms of the impact on the personality of the convicted person. At the same time, practice has shown that without its application, it is impossible to exercise effective control over crime. The Republic of Kazakhstan, as an independent state, has come a long way in the formation of its penitentiary system over the past thirty years of independence. At the same time, most of the negative elements that were inherent in the Soviet period continue to be relevant for sovereign Kazakhstan. In particular, in the conditions of isolation of convicts from society, a specific criminal or semi-criminal environment has formed. With its own specific subculture and system of organization and management. The proposed article examines the problems of the prevalence of this specific social phenomenon in correctional institutions of the Republic of Kazakhstan. According to the author of the article, the main conductors of her ideas of the criminal subculture are the so-called \u00abthieves in law\u00bb. This category of criminals is not new both for sovereign Kazakhstan and for all post-Soviet states. The author draws attention to the fact that in modern conditions, this category of leaders of the criminal environment and their subcultural relations have undergone serious changes. Even under the strict imperative of informal norms, representatives of the so-called \u00abthieves’ community\u00bb began to allow a certain kind of departure from pre-existing norms. At the same time, those that are commonly referred to as \u00abbasic\u00bb are still preserved today. The author notes that, unlike the Russian Federation, Kazakhstan intends to solve the problem with this category of criminals by all available means.<\/p>\n
